Commissioner's Statement on the Public Release of the Report

The Inquiry's evidentiary hearings and closing submissions were concluded on February 8, 2011. During the writing of the Report the Commissioner decided to seek additional information about issues surrounding Mayor Hazel McCallion's gala that was held in mid-February. The Commission conducted additional interviews.

"We believe that it was important to the report and to the public to complete these interviews and review this additional material," said Commission Counsel Will McDowell. Parties to the Inquiry had an opportunity for additional input before the Report was completed.

The proceedings were televised live on Rogers Television and on the web. The video is archived on the Rogers page. Transcripts of the proceedings are posted on the transcripts page on this website.

The Inquiry started hearings with applications for standing on December 14, 2009 and began hearing evidence on Tuesday, May 25, 2010. The last day of evidentiary hearings was December 16, 2010. During that period, the Commission heard from 35 witnesses during 31 hearing days. Closing submissions by the parties concluded on February 8, 2011.

The Commissioner divided the Inquiry into two phases. The first dealt with the December 2000 Enersource Shareholders Agreement to which the City was a party. The second phase dealt with its mandate to investigate issues in connection with the acquisition by the City of Mississauga of approximately 8.5 acres of land in the city centre. The last two days of the hearings featured a panel of experts on administrative law, municipal governance and ethics.

The hearings were held at the Inquiry's hearing room in the provincial courthouse at 950 Burnhamthorpe Road West in Mississauga. The closing submissions for Phase Two were heard in Toronto at 180 Dundas Street W.


City of Mississauga Judicial Inquiry

The City of Mississauga Judicial Inquiry was an independent judicial inquiry that was established under Section 274 of the Municipal Act 2001 by a vote of the Mississauga City Council on November 11, 2009.

Mr. Justice J. Douglas Cunningham, Associate Chief Justice of the Superior Court of Justice of Ontario, is the Commissioner.

The Inquiry investigated issues in connection with the acquisition by the City of Mississauga of approximately 8.5 acres of land in the city centre and issues in connection with the December 2000 Enersource Shareholders Agreement to which the City was a party.
